Diane M. Saunders
Diane M. Saunders is a partner with the firm. Diane assists employers and managers with all types of employment matters arising in Massachusetts, New York and throughout the United States. Diane is a member of the bars of Massachusetts and New York, and is admitted to practice before the United States District Court for the District of Massachusetts, United States District Courts for the Southern and Eastern Districts of New York, United States District Court for the Eastern District of Wisconsin, United States District Court for the Eastern District of Michigan and the United States Courts of Appeals for the First, Second and Third Circuits.
Diane handles both single plaintiff and class action employment disputes before federal and state courts, arbitrators, and administrative agencies (including the Massachusetts Commission Against Discrimination, the New York State Division of Human Rights, the New York City Commission on Human Rights, the Equal Employment Opportunity Commission, the Department of Labor and the Attorney General’s Office). Representative cases include discrimination, harassment, retaliation, wage and hour, trade secret and non-competition issues, wrongful discharge, and workplace torts and contract disputes.
Diane also provides day-to-day advice and counseling to her clients on a wide variety of employment issues, such as making reasonable accommodations, handling leave of absence issues, disciplining and terminating employees, investigating claims of harassment, and protecting trade secrets and confidential information. Diane regularly reviews employment handbooks and personnel policies, and drafts employment agreements and non-competition agreements.
Diane is an active member of the Labor and Employment Law sections of the American Bar Association, Massachusetts Bar Association and the Boston Bar Association. She is also a former Board member of the Women's Bar Association of Massachusetts. Diane is a frequent speaker at education programs for attorneys, human resources professionals and business owners and managers. Diane was a contributing author of the MCAD Guidelines: Employment Discrimination on the Basis of Handicap-Chapter 151B (1998) and the MCAD Guidelines: Guidelines on the Massachusetts Maternity Leave Act, M.G.L. c. 149, § 105D (2000). Diane has also been a contributing editor of the Massachusetts Continuing Legal Education’s MCAD Case Citator since 2003.
Before joining Morgan, Brown & Joy, Diane practiced employment and civil rights law in New York City at the New York City Corporation Counsel's office under former Mayor Rudolf Guiliani. Prior to that, she served as a law clerk for the Honorable Richard S. Salzman, District of Columbia Superior Court. Diane is a graduate of the University of Vermont (B.A., magna cum laude, 1987) and a graduate of American University's Washington College of Law (J.D., cum laude, 1992).
