Boston Globe Quotes MBJ Attorney on Use of Comp Time As Substitute For Overtime
On August 10, 2008, the Boston Sunday Globe’s Job Doc quoted MBJ attorney Dan Field recently in response to an inquiry about the appropriate use of compensatory time in lieu of overtime. As Dan explained, employers are obligated to pay most hourly employees time and a half for each hour worked in excess of 40 in a work week. Private sector employers are not permitted to substitute compensatory time off for overtime, but may provide comp time in the same work week that extra time is worked because it ordinarily reduces an employee’s hours below 40 in that work week, thereby eliminating the overtime requirement.
