Pender was quoted in the Massachusetts Lawyers Weekly article, “In Andover case, good faith bargaining duty trumps First Amendment.” The article covers a recent Massachusetts Appeals Court decision holding that the Andover Education Association violated its duty to bargain in good faith by using Town Meeting to seek a payment it had abandoned in negotiations, with the court finding no improper infringement of the union’s First Amendment rights.
