Daniel Fishman partners with executives, human resources professionals, and in-house counsel to navigate employment law challenges. While keeping business goals at the forefront, Daniel provides day-to-day advice on topics like workplace investigations, accommodations and leaves, wage and hour compliance, employee handbooks and policies, hiring, performance management, terminations, and reductions in force. Daniel has honed these skills both in private practice and on secondment to a Fortune 500 technology company as in-house employment counsel. This experience gives him a unique perspective on the practical and business challenges that employment issues create for employers.
An experienced litigator, Daniel regularly defends employers in state and federal courts, as well as before administrative agencies such as the EEOC, the Massachusetts Commission Against Discrimination, and numerous other state anti-discrimination agencies nationwide. Daniel defends clients in employment discrimination, retaliation, wrongful termination, Family and Medical Leave Act claims, contract disputes, and wage and hour collective actions. Daniel’s experience includes securing summary judgment for a medical institution facing discrimination and retaliation claims. He similarly obtained a R. 12(b)(6) dismissal for a technology company on several statutory retaliation and common law claims. While he enjoys litigating a case to and through judgment, Daniel successfully resolves matters through favorable settlements when they achieve client objectives.
As a certified employment trainer, Daniel delivers anti-harassment and compliance trainings tailored to the specific workforce and employer needs. Daniel’s engaging trainings go beyond legal checklists to build and sustain a positive and respectful workplace culture.
