MBJ Victory: Jury Trial In Federal Court Finds No Discrimination
Earlier this month, Morgan, Brown & Joy prevailed on behalf of its client in a six-day jury trial in United States District Court (New Jersey) involving a current employee who alleged race discrimination. In Gilmove v. Macy’s Retail Holdings, Inc., the Plaintiff, Janice Gilmore, alleged that she treated differently because of her race in violation of Title VII of the Civil Rights Act and the New Jersey Law Against Discrimination.
On February 10, 2009, Plaintiff’s claims were tried before a jury of eight in Camden, New Jersey. Macy’s prevailed in a wide range of pre-trial motions and arguments during the course of the trial. The jury returned a verdict in favor of Macy’s, concluding that Plaintiff failed to demonstrate that she was denied the same opportunity to sell that her Caucasian colleagues had.
Notably, the case also involved the one of the first analyses of the application of the Ledbetter Fair Pay Act, which was signed into law just days before the trial commenced.
